the taller of the two 仅仅在此情况下，比较级用the 记住了！死记！
简单吧？
第一句说成 He is taller of the two 也可以。如果用the taller, 这句话实际上是说：He is the taller one of the two. the taller 在此当名词用。
第一句有语法错误吧。。
the taller 是名词性短语了，指较高的那个（人）
而第二句里还是形容词用法。
