【内容摘要】 随着我国劳动争议问题越来越突出,以及《劳动合同法》对于企业用工行为的更多法律上的规定和限制,加大了对于违法用工行为的处罚力度。在这样的法律环境下,企业用工的违法成本大大增加。另外,劳动者的维权意识也逐渐增强,使得企业不得不规范自己的行为。据统计,企业在劳动争议的败诉案件中,一半是基于企业规章制度问题导致的,为了避免劳动争议的发生和管理不善而带来的成本,企业需要主动把规章制度列为管理的重要依据,根据《劳动合同法》的相关法条规定建设企业内部的规章制度。本文主要从企业管理中避免和应对劳动争议的角度分析了劳动规章制度的作用,然后从企业规章制度里普遍存在的主要问题入手,指出了现存问题在《劳动合同法》环境下可能引发的更加严重的后果,进而提出企业应如何从规章制度的制订和执行两个方面进行规章制度的建设。笔者认为,企业要化被动为主动,订立严密的合理合法的规章制度协助管理,这将有助于企业劳动关系的稳定,预防劳动争议的发生,从而提高企业人力资源管理的效率。
