摘要: 本文基于对农民的关怀和三农问题的关注，对《物权法》出台前的农村土地承包经营权制度概要和弊端作了一些评述。并指出了《物权法》该制度存在弊端的克服，同时也提出了《物权法》在这一制度设计上尚存的一些不足。最后，本文还进行了进一步的思考，对如何改进和不断完善农村土地承包经营权制度作了一定的探讨。

Abstract: This article based on to farmer's concern and three agricultural question attention, appeared before to "Reality of laws" the countryside land contracting right of management system outline and the malpractice has made some narrations.And had pointed out "Reality of laws" this system existence malpractice victory, simultaneously also proposed "Reality of laws" in this system design the still remaining some insufficiencies.Finally, this article has also carried on the further ponder, how to improved and consummates the countryside land contracting right of management system to make certain discussion unceasingly.
