摘 要
精神损害赔偿制度在我国的民法发展史上可谓历尽波折，从建国到改革开放初期一直围绕这一制度是否有必要存在的问题进行讨论，自《民法通则》等一系列的法律法规出台之后，我国民法理论界和实务界对精神损害赔偿的研究和关注也从该不该赔偿转至如何赔偿的课题上来。2001年2月26日，最高人民法院颁布了《最高人民法院关于确定民事侵权精神损害赔偿责任若干问题的解释》的司法解释。本文以此司法解释为主题展开了对于我国精神损害赔偿制度的探讨，主要对某些概念性问题、精神损害赔偿的范围问题和赔偿数额问题提出了一些见解，另就国家赔偿应否纳入精神损害赔偿做一的浅显分析。
