[摘要] 合同解除是合同法上的一项重要的基本制度，但我国《合同法》中关于合同解除条件和解除后果方面的规定不完善，导致司法适用上的困难。本文立足于我国《合同法》的相关规定及司法实践，运用语义分析法和调查研究法，对合同解除条件进行分析，认为我国《合同法》中关于合同解除法定条件的规定存在不足并提出立法完善。通过对合同解除溯及力的观点的进行比较，认为合同解除原则上具有溯及力，并对在合同溯及力适用的具体情形进行分析。通过对合同解除与损害赔偿关系、赔偿范围进行分析，认为关于合同损害赔偿范围规定不够全面，并提出相关完善建议。以期抛砖引玉，促进我国合同法的日臻完善，对日后我国民法典的制定有所裨益。
