对现在或是将来的虚拟，从句一律用were吗？

这里为什么用现在是:
If the bills aren't (为什么不是 weren't )paid in five days, the company will seek damages.
好像和下面的解释不一致

如果钱5天内不付掉，公司就有损失了。

显然，这个是个假设。不是过去，这个能理解吧？
如果是说过去的事情，就得这么:

The company was damaged because the bills weren't paid.

我看了下，那个太专业化，老外都不会去看的。。。真的。我长期在国外生活，至少你知道这个就不会错。
