摘 要
本文探讨了产品责任损害赔偿范围。 产品责任损害赔偿指有缺陷的产品造成他人人身、财产等损害时，该产品的制造者、销售者以及其他相关主体所应承担的特殊侵权责任。各国产品责任立法对于损害赔偿的范围规定都不一致。各国立法对于缺陷产品引起的人身损害、财产损害，一般都规定予以赔偿；对于精神损害、产品自身损害及纯经济利益损失的赔偿，则存在分歧。产品损害赔偿范围，是法律界争议较大并致力解决的问题之一。本文从法的角度对我国产品责任法关于产品损害赔偿范围的规定作了归纳整理，拓展了本问题研究的思路和观点。本文主要分三部分。
第一部分阐述了产品责任损害赔偿的概念，产品损害赔偿的构成要件，以及产品损害赔偿的法律依据，其中具体说明了产品损害赔偿的标准和惩罚性赔偿金的确立。第二部分分析了产品损害赔偿范围。一般可分为四类：(1) 人身伤害赔偿；(2) 财产损失赔偿；(3) 精神损害赔偿；(4) 产品自身损害赔偿。第三部分产品损害赔偿范围存在的不足及其完善。
在我国的法律体系中对产品责任损害赔偿制度的规定尚不完善，还没有形成统一的《产品责任损害赔偿法》。完善这一制度，有利于对人身损害赔偿、财产损害赔偿及惩罚性损害赔偿等重大问题的解决，使消费者的权利得到有效保护，同时使企业不断强化质量管理意识，提高人们的生活质量，是构建社会主义和谐社会必不可少的重要环节。

Abstract
This paper discusses the scope of product liability damages. Product liability refers to damages caused by defective products has another person, property damage, the product's manufacturer, sales and other related subjects to be incurred by the special tort liability. States product liability legislation the scope of the damages provisions are inconsistent. National legislation for defective products arising from personal injury, property damage, general provisions of compensation; for moral damage, product damage and pure economic self-interest loss, then there are differences.
