我国个人住房贷款制度自上世纪80年代末产生以来，在十余年的时间里得到了巨大的发展，在银行发放贷款总量中，商品房预收贷款占据了巨大份额。本文分析了商品房预售中一些相关法律关系，引出银行在其中的法律地位，指出银行风险，从而又设计了一些防范途径。
