在民事诉讼中，举证责任分配地位非常重要，是民事诉讼的“脊梁”①据问题上发挥主导作用，强化当事人的举证责任，是我国审判方式改革的要求。如何确定当事人的举证责任，事关当事人的重大利益和判决的公正。我国民事举证责任分配制度在原有规定的基础上，借鉴国外学说的有益成分，较过去有了很大进步，但仍然存在一些缺陷。本文旨在认识我国诉讼举证责任的同时发现不足以及完善构想。
