环境责任保险制度是环境侵权责任风险社会化的产物，它通过运用市场机制的手段来解决环境侵权损害赔偿的问题，及时有效地保障受害人的合法权益，弥补受害人的损失，分散企业经营风险，利用费率杠杆机制促使企业加强环境风险管理，维护生态系统的平衡，促进资源的可持续利用,有利于企业的健康运行，维护社会的稳定,减轻政府的负担，可以比较好的弥补一般侵权行为法理论的不足，因而它的产生与发展日益受到世界各国的重视和关注。虽然环境责任保险制度有着很积极的意义，但是目前在我国实施的情况并不乐观，与之配套的相关制度也没有建立起来。因此，加快我国环境责任保险制度的构建，是切实推进环境保护历史性转变的迫切需要，是环境管理与市场手段有机结合的有益尝试。
本文拟通过对环境责任保险制度的基础理论、具体内容，世界各国对于环境责任保险的立法和司法实践、我国的环境责任保险制度的现状和不足等问题的研究，以期为我国构建和完善环境责任保险制度提供建设性的意见。
本文将分为四个部分进行论述，第一部分是环境责任保险制度的概述，主要介绍环境责任保险的概念、特征、产生与发展的过程、性质，突出介绍了环境责任保险制度的优点，包括可以及时有效地弥补环境污染受害人的损失、防止政府用全体纳税人的钱来分担私权侵害的结果等，以期引起读者对环境责任保险制度的重视；第二部分是对环境责任保险基本理论的研究，包括环境责任保险与侵权行为法之间的关系以及建立环境责任保险制度的必要性研究，这是我国环境责任保险制度赖以实施的基础；在第三部分对西方主要国家环境责任保险制度的产生、发展实践进行比较分析，探索各国不同模式下的环境责任保险制度在立法和实践中的优势和不足，以期对我国的环境责任保险制度的构建有所启示；第四部分介绍环境责任保险制度在我国发展的现状以及为我国如何构建环境责任保险制度提出自己的设想和立法建议，以期对我国建立环境责任保险制度有所帮助。
