摘要:本文通过行政法学和政治学的角度对湖南省政府新近制定和通过的《湖南省行政程序规定》进行解读，进而透析我国行政程序立法进程。通过对行政程序意义的阐释，将其与以法治国、宪政政府和善治政府联系起来。同时，着重对这部地方行政法规的行政公开制度和行政听证制度进行解析。
《湖南省行政程序规定》的出台的意义，不单单局限于行政程序法的破冰之举，也是我国立法模式的一次新的尝试。程序规定的出台，第一次摆脱了重大法律由“中央到地方”的传统模式。从政治学的角度来讲，政治精英由下至上的推动政治改革。这一次地方立法的成功，可以为中央集权制度下探索中央与地方的良性互动提出有益的经验。地方的自主性与能动性在地方立法中得到很好的重视，同时还为中央立法提供经验，为早日推出国家级的行政程序法提供良性的压力。通过湖南省的这一次破冰举动，政治精英特别是其中的法律精英们可能会更加注重从地方层面上去关注政治改革，从而增强地方立法在政治体制运作之中的活力，为地方政治权力的自我良性动作提供法治保障，进而有助于改变我国纵向权力体制“一死就放、一放就乱、一乱就收、一收就死”的怪圈。
解读湖南省行政程序规定的这一次破冰之举，既可以从政治学的角度来透析大众参与、地方互动在公共政策创制过程中的作用，也可以从法学学理的角度解读行政程序规定所体现的出的法治原则与制度正义。本文尝试从后一种角度对程序规定进行学理的分析，并反映出这部地方法规创制过程之中所体现出来的政治互动。
