Seller under exclusive governance of this contract guarantees the buyer 2% of the contract of each shipment as a guarantee for the discharge of his obligations relating to the shipment after receive the L/C for each shipment. However, the seller failing to comply with the shipment as contracted the buyer has a right to claim the performance guaranteed amount for such non-performance on the part of the seller. This performance guarantee forms an integral part of this contract and limits the liability on the part of the seller for any explicit or implicit losses to the buyer that might arise due to his non-performance, market fluctuations or any other cause or factor linked directly or indirectly or not liked at all to the sellers non-performance, strictly to the amount of the performance guarantee only.
