笔者所写的论文题为《未成年人刑罚制度的研究》，而对未成年刑罚制度进行探讨和研究其目的就是为了保护未成年人的合法权益。未成年人的合法权益，预防青少年再犯罪，是我国所提倡的现代化法制建设的重要内容。未成年人犯罪刑罚体系和刑罚适用制度，是未成年人刑事责任制度的不可或缺的一部分。由于未成年人的社会地位特殊，其心理，生理特点和认识能力以及行为能力受到相对的特殊保护。但现实情况是在我国，对青少年犯罪定罪处刑适用的是和成年人犯罪也适用的同一部《刑法》，与当前国际上少年司法制度发展趋势所提倡的对于未成年人犯罪的双重保护原则，减少司法干预，反应相称原则，处罚社会化原则尚有一段不小的差距，急需完善。笔者针对未成年人犯罪的社会背景和形式严峻性，未成年人刑事责任年龄；未成年人的司法裁量权问题；扩大关于未成年人取保候审制度的问题；未成年人的缓刑制度；对未成年适用罚金刑的异义；建立未成年人犯罪前科制度异义以及对于我国未来关于未成年人犯罪刑罚制度完善等一系列未成年人犯罪刑罚适用方面的热点问题作一浅显的分析，并提出自己的一些不成熟的建议和观点，供老师们参考，更希望老师对我论文中的一些不足和缺点提出批评或看法。
