Divorce orders dissolve the marriage and separation orders provide for the separation of the parties. Both orders come into effect on being made and separation orders will continue while the marriage continues or until cancelled by the court on the joint application of the parties.
The circumstances in which such orders can be made, on an application by one or both parties, are:
● the marriage has broken down irretrievably;
● the requirement of s 8 - information meetings – are satisfied;
● the requirement of s 9 – future arrangement – are satisfied;

If an application for a divorce order is being considered and application for a separation orders is made in respect of the same marriage, the court will deal with the case as if only a divorce order application was being made unless:
● a s 10 order is in force;
