网络虚拟财产这一新兴的社会现象，由于在学术界与司法界对其法律属性的认识存在分歧，进而导致了针对网络虚拟财产个案的法律适用的争议。笔者试图从网络虚拟财产产生的法律问题入手，把握住网络虚拟财产背后的财产性质，确认了其物权的本质属性，分析目前我国法律制度对虚拟财产进行保护的必要性，制定出与此相适应的法律保护模式。
