摘 要
超期羁押，就是超过法定期限的羁押。它侵犯了嫌疑人、被告人所享有的基本人权，违反了“正当法律程序”原则，也是一种违法犯罪行为。其长期存在的原因在于：“有罪推定”、“重实体、轻程序”和“重打击、轻保护”等传统观念的根深蒂固，缺乏司法审查和司法救济机制，羁押期限和办案期限的合二为一，缺乏人身保护令、保释制度，以及缺乏有效的责任追究机制等。西方国家已普遍建立了对羁押措施的采取、羁押期限及是否保释的司法审查和司法救济制度。我们应从改变传统观念，深入司法改革，建立、完善有关制度，以及强化监督制约，建立责任追究制度等方面入手，根除超期羁押这一违法现象。
