General Duty of Care Guidance Notes

1，这是民法部分commercial law 的一部分，只是我们的教材，也是Negligence（过失）的一部分。
2， 这是Negligence的构成：
The Three essentials:
• that the defendant owed the plaintiff a duty of care
• that the defendant failed to conform to the required standard of care (ie. that the defendant breached his duty of care)
• that there was a sufficient connection in law between the defendant’s conduct and the damage suffered by the plaintiff
3，duty of care是指一般照顾，注意的责任，比如说，由于疏忽造成的医疗事故就是典型的过失的案例。
