The relative draft shall be drawn by Seller on the issuing bank of said letter of credit, unless otherwise agreed. If Buyer fails to provide such letter of credit, Seller shall have the option of reselling the goods without any previous notice to Buyer, or holding the goods at the Buyer’s expense and risk, together with the option of canceling any part of the whole of this contract and claiming for loss damage caused by the Buyer’s default. Such loss or damage shall be indemnified by the Buyer immediately. In case a payment without a letter of credit, unless otherwise specified, the payment shall be made by Buyer under document against payment(D/P) at sight. Any loss of Seller’s proceeds resulting from market fluctuation or transportation concerned shall be borne by buyer. If Buyer shall default in warranting further shipments to Seller, Seller shall have the option to delay and shipment or cancel thos contract in part or in whole at any time.
