【摘要】 夫妻财产制是我国一项重要的法律制度，这一制度不仅在一定程度上将决定人们的婚姻走向，而且关系到民事交易安全，因此完善夫妻财产制度是我国《婚姻法》修改中的重要议题，该文主要探讨我国现行夫妻财产制度中存在的缺陷，思考如何使我国夫妻财产制内容科学化，体制完整，更具有操作性。

试论国家赔偿归责原则的缺陷与完善
【摘要】 《国家赔偿法》的制定和实施在我国法制建设中具有里程碑的意义。国家不仅要求公民守法，也要求国家机关及其工作人员对自己的职务侵权行为承担责任，这说明国家已经认识到它同老百姓之间是平等主体间的关系，这一点是难能可贵的。但是《国家赔偿法》的实施效果并不理想,国家赔偿归责原则作为国家赔偿制度体系的重要组成部分，在施行的过程中同样明显地暴露了它的局限性。现行的国家赔偿违法归责原则过于单一，既造成在实践中操作难、缺乏灵活性，也造成国家赔偿的范围过窄、不能全面体现国家赔偿的责任事项等。本文认为，就单一的违法归责原则，应确立多元化的归责原则体系，纳入过错归责原则、无过错归责原则、结果归责原则等。鉴于此，本文将通过对现行国家赔偿归责原则的阐述，结合相关的案例，分析其存在的主要缺陷，并提出完善的意见和建议。
