We are unable to process this amendment as requested. By removing this clause there may be an understanding by the second beneficiary that we have added our confirmation to this L/C - which, as discussed previously, is not the case. Your supplier (and/or their banker) can only be requesting this amendment in order to try to create a payment obligation by Westpac.
The only course of action from here is as follows:
1. Do nothing, the L/C remains as it is currently and payment will be made to your supplier once we have received payment from the L/C issuing bank.
2. Westpac adds its confirmation to the L/C and charges WDJ Resources for the cost. Once this has been done we can process your amendment.
3. Amend the L/C from India to remove the confirmation clause.
