摘要: 本文基于对农民的关怀和三农问题的关注，对《物权法》出台前的农村土地承包经营权制度的历史演变及其弊端作了一些论述。并指出了《物权法》对这些弊端的克服，同时也提出了《物权法》在这一制度设计上尚存的一些不足。最后，本文还针对这些不足，提出了改进和完善农村土地承包经营权制度的建议和对策。

Abstract: This article based on to farmer's concern and three agricultural question attention, appeared before to "Reality of laws" the countryside land contracting right of management system historical evolution and the malpractice has made some elaboration. And had pointed out "Reality of laws" to these malpractice victory, simultaneously also proposed "Reality of laws" in this system design the still remaining some insufficiencies. Finally, this article also aims at these insufficiencies, proposed improves and consummates the countryside land contracting right of management system the suggestion and the countermeasure.
