律师参与刑事诉讼是一项十分重要的制度。保障律师在刑事诉讼中的各项权利，不仅可以充分发挥辩护制度在刑事诉讼中的作用，对切实保护犯罪嫌疑人、被告人的合法权益和达到维护基本人权、实现社会正义也有着十分重要的意义。
我国现行《刑事诉讼法》不仅强化了律师在刑事诉讼中的地位和作用，还进一步明确了律师在各个诉讼阶段的权利。但仍存在一些问题，法律赋予律师的权利不完整，对律师的权利限制较多，律师权利的行使也缺乏相应的保障措施。此外，受人们的观念和法治环境等因素的影响，法律赋予律师的权利在实践中被侵犯。如律师的会见权、阅卷权、取证权经常受到限制;律师在侦查阶段的作用难以发挥;在庭审中的权利得不到应有的尊重;执业中的人身权时常被侵犯。不仅导致我国刑事诉讼中控辩双方力量的不平等，也使得律师刑事辩护职能难以有效的发挥。
律师参与刑事诉讼存在的种种问题己影响了我国刑事司法改革的深入进行，因此，有必要从立法上进一步完善辩护律师的权利，解决上述问题,进而在制度上充分保障辩护律师权利的行使。这样不仅可以明确辩护律师合法的诉讼主体地位，还可以从法律上消除对律师行使权利的限制。对侵犯辩护律师权利应承担的责任，立法上也应做出具体规定。这样才能真正建立起控辩平衡的控辩式诉讼结构，充分发挥律师在司法公正和保障人权方面的特殊价值。
本文在分析我国律师在参与刑事诉讼过程中存在缺陷的基础上，就律师在刑事诉讼中的存在问题的原因和解决的必要性进行分析,同时还就解决上述问题提出了若干改革与完善对策。
