4. buyer’s property
a) buyer assumes no obligation to furnish supplier with any tools, equipment or materials for the performance of supplier under this contract except as may be expressly provided otherwise; however, if supplier or its subcontractors or the employees, representatives, agents or invitees of any of them, make use of any tools, equipment or materials owned by buyer, such tools, equipment or materials shall be accepted in “as is” condition, without any warranty whatsoever, express or implied, and supplier shall indemnify and save harmless buyer (including its directors, officers, employees and agents) from and against any and all loss or liability (including reasonable attomey’s fees and court costs) relating to or in respect of any failure of such tools, equipment and/or materials to be suitable for their intended purpose or for any damage, destruction, injury or death arising from the use of such tools, equipment and/or material.

4 买方权利
a）本合同中，买方没有向供应商提供履行合同所需的工具、设备或材料的义务，买方主动提供除外。但是，如果供应商、承包商、雇员、代表、代理或被邀者使用买方的工具、设备或材料时，这些工具、设备或材料需无条件列入“如果”条款。也就是说，如果买方的工具、设备或材料或提供的指导人员、雇员、管理人员和代理被用于非买方目的或造成设施设备损坏、人员伤亡与买方无关，买方也不负责律师费和上庭费用。
