伊拉克战争,让人们对国际法存在的意义发生了疑问,对国际法的作用表示出极大的怀疑：国际法基本原则遭到践踏，联合国集体安全体制受到挑战，一系列新的国际法律问题等。这主要是由不完善的国际法律责任制度和实施机制、联合国的体制性弊端、国际法和国际组织作用的限定性和法律的滞后性等原因决定的。国际社会只有完善国际法，锐意改革联合国集体安全体制，解决反恐和伊拉克战争中出现的新问题并推动国际社会多极化，国际法才能得以良性和顺利的发展。本文针对伊拉克战争对国际法的种种挑战、挑战的原因以及相应的法律对策作一些初步的探讨。
