内容摘要:我国《物业管理条例》和《物权法》都没有确立业主委员会的法律地位,导致业主委员会的民事活动根本无法展开,实上剥夺了业主委员会管理物业的诸多权利,势必波及业主合法权利的有效实现。本文通过的论述,本人认为,虽然在我国现有的国情下赋予业主委员会法人人格是不现实的,但在现有的法律制度的框架内,确立业主委员会一定的法律地位,赋予气相应的起诉与应诉权利是必要的,也是可行的。

Abstract:
