实施《劳动合同法》企业劳动用工管理的风险分析

摘要:《劳动合同法》于2008年1月1日起施行后,由于对劳动合同法的学习、认识不足,以及在金融危机及经济衰退的冲击下,为避免增人风险,降低用工成本,企业仍在临时性用工、劳动合同试用期、合同期、竞业限制、规章制度管理等诸多方面存在违法违规问题。要彻底贯彻落实劳动合同法,保证企业和谐、健康发展,企业及各级人事管理工作者首先必须清醒地认识劳动合同法实施后企业劳动用工管理方面仍存在的各种风险,其次是依法修订、完善原有的规章制度,规范管理,严格执行。本文中,笔者根据多年的国企人事管理经验,总结分析了《劳动合同法》对企业的影响、企业劳动用工管理方面存在的风险,接着提出了企业规避各种风险的对策,对企业全面、正确贯彻落实劳动合同法具有一定的参考价值。
