【内容摘要】随着全球一体化速度加快，我国经济体制不断地与国际金融接轨，贷款诈骗成为当前中国经济犯罪活动中危害最大的犯罪类型之一。本文通过从贷款诈骗罪的构成要件以及犯罪形态，分析了本罪与易混淆他罪的界限，更好地从本质上理解贷款诈骗罪，还有结合实践中常见的问题来讨论非法占有为目的内涵，提出建议将单位规定为贷款诈骗罪的主体。
