程序正义的重要性在当今法制界乃至整个社会都被越来越多的认识到，程序的价值、注重制度的构建，已成为现代法治文明的一大显性表征。程序正义与法律职业道德并列被称为当代具有重要意义的法治的两个推动力，也是中国法走向形式化进而走向现代化的根本元素之一。其在法律使用中对适用者权力进行约束，促进理性选择，并对适用结论的妥当性提供了支持。因而程序正义在司法实践中起着不可替代的作用。在正处于司法改革转折之处的当今中国，也开始高度重视法律程序制度的构建，“程序正义”的理念已经成为中国司法改革的重要价值导向之一。相对于英美法系对程序正义一贯地严格追求，中国在程序正义与实体正义的理念与实践方面一直处于不断地摸索与探究之中。而在当今经济全球化的背景下，各国法律制度理应相互修正，取长补短，以更好的实现追求公平、正义的共同价值目标。因此本文择取了英美法系代表国家----美国，将其在刑事诉讼中的庭审程序和价值理念等与中国进行比较，通过对中美两国刑事诉讼中程序正义的比较与研究，力求能够揭示蕴藏其中的价值观和司法理念，汲取精华，使之“内化”为我国刑事诉讼改革的助推力。希望在一定程度上诠释“程序正义”的内涵和精髓，期待中国的刑事诉讼制度改革能够彰显程序正义之精神。
