信访制度设立的初衷是执政为民和以民为本，维护人民群众的合法权益，进一步密切党和政府与人民群众的血肉联系。从当前信访所统计的资料来看，可以说绝大部份是信访人对行政机关的处理不服、对司法机关的裁决不服之类的问题。主要涉及农村土地徵用、城市房屋拆迁、移民搬迁安置、公安行政执法、土地行政执法、企业重组改制破产等诸多问题。而其中一些问题完全可以通过行政诉讼、行政复议或者申诉来解决。司法机关的判决无论在任何国家都是最具权威性的了，为什麼人民群众不相信司法判决而去进行上访？是什麼导致信访案件居高不下？这些问题本人将从《宪法》、《行政复议法》、《信访条例》等多部法律以及与国外类似的信访制度进行比较结合一些不同的学术观点进而阐述本人对信访制度持肯定态度。
