2008年的10月20日的“微软黑屏事件”更是引发了国内外对于计算机软件保护问题的轩然大波，掀起了一股中国对计算机软件维权保护领域的探讨热浪。近一年，对于如何完善我国计算机软件保护的立法、维权行为的限制，以及平衡、调节维权“过度” 与侵犯用户权利之间的关系等方面的问题已成为目前人们探讨的热门话题之一。
本文将围绕08年“微软黑屏事件”所引发的计算机软件保护过度现象，做进一步的探讨与研究，并通过法学理论与近年发生的实际案例相结合来分析我国计算机软件维权保护行为应当遵循哪些原则实施？如何平衡维权行为与侵权利益之间关系等问题。其中在文章第一部分将对计算机软件保护做一个概括性的阐述；随后的第二部分将分析和研究近年发生在国内外的计算机软件侵权、维权案所带来的计算机软件保护过度问题；第三部分与第四部分将着重讲述我国近年在计算机软件法律保护中的实际操作情况与存在的不足，其中重点探讨了计算机软件保护应当遵循适当性原则，以及如何平衡存在于软件保护行为中的权利与利益之间冲突的关系；而在末尾的第五部分作者将对我国今后在计算机软件保护的领域中应如何完善提出了一些自己的观点与见解。
