近年来，随着经济快速发展，环境污染事故也频频发生，而且往往危害范围极广、甚至影响社会安定。为了减轻环境损害的恶劣后果，尽可能地保护各方的利益，减少政府环境压力，环境责任保险就应时而生了。目前，我国的环境责任保险制度尚处于探索研究阶段。因此，有必要对环境责任保险的基础理论进行研究。
本文在分析环境责任保险内涵的基础上，从环境责任保险的法理基础、经济学基础、环境经济损益分析方法等方面对环境责任保险的基础理论进行了研究，论证了环境责任保险在侵权法上具有正当性，同时还论证了环境责任保险具有强化侵权法的补偿功能的作用；研究保险法的责任保险理论，为环境责任保险的实现提供法律基础；发掘环境责任保险制度的法的公平价值和效率价值基础；提出了环境责任保险中除外责任范围和索赔时效；从市场供给、市场需求等方面分析了环境责任保险经济上的可保性，并利用经济学原理研究出环境责任保险费率（弹性费率）和责任限额的计算依据；从环境经济损益分析方法研究其保险计量方法，建立了经修正的合理的环境经济损益分析方法，提出了环境风险、污染损失的科学评估方法。
通过本文的研究，不仅可以拓展环境责任保险在侵权法、责任保险理论和环境经济学等方面的研究范畴，还可以为我国开展环境责任保险提供一定的经济损益分析方法，从而确定赔偿费率和责任限额等参数。此外，环境责任保险的理论研究对于开辟环境责任保险新的保险种类及其设计、完善我国环境责任保险制度具有一定的理论指导意义。
