第二个法律渊源就是法律，这里所说的法律是指的狭义意义上的法律，仅仅指由全国人大或者是全国人大常委会制定的规范性文件。法律的地位和效力仅次于宪法。
第三个法律渊源是行政法规，那么行政法规顾名思义应该是由行政机关制定的，那么这个行政机关就是我国的最高行政机关：国务院。行政法规的地位和效力次于宪法和法律。
第四个法律渊源是地方性法规，就是由地方的立法机关制定的，这些地方立法机关指的是省、自治区、直辖市的人民代表大会或者是人民代表大会常务委员会以及省、自治区、直辖市所在地的市的人大或者人大常委会，也就是省会市。
第五个法律渊源是行政规章，所以，行政规章也是由行政机关制定的，主要包括部门规章也就是国务院所属的各部门和地方规章是由地方政府制定的。
第六个法律渊源是特别行政区的法律和民族自治地方的自治条例和单行条例。
最后一个法律渊源就是国际条约和国际惯例。
