摘要：随着我国改革开放步伐不断加快，市场经济的发展和社会文明的不断进步，公民个人财产和家庭财产不断增加，夫妻财产关系日趋复杂，公民素质不断提高，人们的价值观念发生了巨大改变；加之，现代社会人们的自我意识和个人权利意识不断增强，由此，夫妻以契约约定夫妻财产关系的情况越来越多，夫妻财产约定制度的法律地位也显得越来越重要。随之2001年《婚姻法》（修正案）新增的第19条规定迎合了我国这一现实的需要，虽然这一规定能有效解决我国夫妻财产约定制度的部分法律问题，但也存在一些不足的地方，如对夫妻财产约定时间及生效时间立法没有作出明确规定，缺乏对夫妻财产约定所应具备实质要件的规定等等。本文针对我国现行婚姻法对夫妻财产约定制度规定存在的缺点，通过对我国新中国建立以来相关法律对夫妻财产约定制度的探讨与分析并结合我国夫妻财产约定制度存在的缺陷提出完善我国夫妻财产约定制度的相关立法建议。
