Abstract: It is a big trouble of financial industry in our country that most of the banks in China has been stucking to a lot of bad assets. As the financial market continuously openning, especially after China's entry to WTO, foreign financial organizations will rush into and bring enormous shocks to our domestical financial industry. Therefore, various troubles of bad assets must become the barriers of the financial industry development. This article stands on the point of legislation to analyze the causes and development of bad loans or credits within China's commercial banks. The possible legislation solutions are consequently discussed according to the analysis by the author with the attempts to decrease the occurrence of the bad loan within the commercial banks.
