历朝政府关于婚龄的法规，有两种类型。一是常规的，确定法定婚龄，即规定男女到多少岁才可以结婚；一是临时性的，视当时社会情况而制定，这种法规就一个朝代讲是偶见的，把许多朝代的串在一起，也可以发现它们的共同性：是为解决一个突出的社会问题而制定的。
政府强迫人民到一定年岁必须结婚，否则给以制裁。我们所见记载，此说提得最早的是墨子所说的圣王时代，也即古人所说的三代以上吧。墨子讲：“昔者圣王为法曰：丈夫年二十，毋敢不处家，女子年十五，毋敢不事人，此圣王之法也。”(《墨子·节用上》)墨子认为上古男子20岁、女子15岁必须结婚，这是法令规定，不敢不遵行。墨子说的是那一个时期的事实，有没有这一事实，很难确证。我们确知政府实行这一政策最早的是春秋时代的越国。越王勾践被吴国战败回到会稽，卧薪尝胆，准备力量进行复仇，实行“十年生聚，十年教训”的方针。“生聚”的内容之一就是为增殖人口，因而宣布：
“女子十七岁不嫁，其父母有罪；丈夫二十不娶，其父母有罪。”(《国语·越语上》)这是把男20岁、女17岁定为最迟结婚年龄，即必须结婚的年岁，而不是可以婚配的岁数。
西汉惠帝六年(公元前189年)诏令：“女子年十五以上至三十不嫁，五算。”(《汉书·惠帝纪》)汉代人口税中有一种算赋，是15岁至56岁的男女成年人交纳的，每人一算，120钱，但是商人和奴婢要交二算。惠帝这个法令使15岁至30岁的未婚女子多交算赋，且达常人的5倍，商人交二算是为实行重本抑末政策。这一婚龄规定对未婚女子的处罚比商人重得多，简直是把她们当作罪人对待了。
