摘 要
夫妻离婚财产分割制度是在夫妻双方婚姻正式解除时，所发生的夫妻财产清算和债务清偿的一种制度。夫妻财产制度主要分为约定夫妻财产制度和法定夫妻财产制度，法定夫妻财产制度又把夫妻财产划分为夫妻个人私有财产和夫妻共同共有财产。按照夫妻财产分割制度划分夫妻财产能够公平划分夫妻财产，维护了公民的合法财产权利不受侵犯，并且和谐地处理夫妻离婚关系。而夫妻财产本属于私人财产，再加上夫妻离婚前的财产关系并不像一般的财产关系，其往往由于涉及各方面的因素和取证困难而造成在财产分割上存在比较大的难度。本文简略回顾了离婚财产分割制度的法律依据，夫妻财产划分的原理以及其分割方法，并且提出了关于司法实践中遇到的举证难的情况，并对解决举证难提出了一些想法。
