新时期，随着国际经济和社会形势的迅猛发展和激烈变化，国与国之间分工又合作、合作又竞争的关系越来越明显、复杂，国际间窃密与反窃密、谍报与反谍报的斗争越来越激化，特别是随着我国市场经济的快速发展和国际地位的不断上升，国内外各种敌对势力对我窃密活动日趋猖獗，窃密与反窃密的斗争日益转向高技术抗衡领域。而与此同时，我国的保密依法行政却存在着诸如保密行政主体地位和执法依据的合法性不够、执法程序不完善、定密不规范、执法手段不多、执法效果偏“软”以及执法队伍建设薄弱等困境和问题，这种情况大大削弱了保密依法行政的水平，给国家秘密的安全埋下了深深的隐患。究其原因，主要有：保密行政管理部门及其人员的依法行政意识不强，人治思想在作怪；保密依法行政体制不顺畅；保密法律法规不完善；地方和部门保护主义的影响以及缺乏有效的保密行政法制监督。要解决这些问题，必须从体制层面、立法层面、执法层面、行政司法层面以及现实层面上入手，采取强有力的措施，进行综合配套的调整和改革，只有这样，才能继续推进我国的保密依法行政进程，更好地维护国家秘密的安全。
