3. EXCLUDED INFORMATION
The obligations of this Agreement shall not apply to any Confidential
Information to the extent that it:
a) is in the possession of the Receiving Party prior the receipt from the
Disclosing Party;
b) is or becomes publicly known, otherwise than as a consequence of
either any breach of this Agreement or any other breach of
confidentiality obligations;
c) is developed independently by the Receiving Party;
d) is disclosed by the Receiving Party to satisfy the mandatory demand by
a competent court or governmental body provided, however, that in
these circumstances the Receiving Party shall advise the Disclosing
Party prior to such disclosure so that the Disclosing Party has an
opportunity to defend, limit or protect against such production or
disclosure; or
e) is received by the Receiving Party from a third party e
