[摘 要]死刑是人类应用最久的刑罚，具有极端威慑的作用，它对于惩罚、预防犯罪和维护社会稳定有着不可抹杀的作用。然而死刑也有其不可避免的消极作用，因此，废除死刑是历史的趋势。死刑存废建立在一定的社会基础上。在我国，废除死刑是一个长远目标，采取过渡措施减少死刑并限制死刑的适用，进而在适当时机废除死刑，是比较合理的途径。

(摘要)Application of the death penalty is the oldest human penalty, the role of extreme deterrence, punishment for it, the prevention of crime and maintaining social stability can not be denied the role. However, the death penalty has its inevitable negative effects, therefore, to abolish the death penalty is a historical trend. The establishment of the retention or abolition of the death penalty in certain social basis. In China, the abolition of the death penalty is a long-term goal, to take interim measures to reduce the death penalty and limiting the application of the death penalty, then at an appropriate time to abolish the death penalty is a more reasonable way.
