Neither Seller nor Buyer, as the case may be, shall be liable for any delay or failure or performance under this contract caused by or resulting from any contingency or cause beyond its control or beyond the control of its supplier or the carrier of the material, including but not limited to calamities of embargoes, labour difficulties, delays of carriers, shortage or requisition of suppliers or transportation and other similar or dissimilar occurrences, whether legal or illegal.
