摘 要
本文通过对赋予我国律师刑事责任豁免权制度的理论依据、现实依据和法律依据的分析，得出“赋予律师刑事辩护豁免权是由辩护律师所担负的职责和刑事辩护的特殊性所决定的”的结论。现阶段法律法规和新《律师法》等对律师行使辩护权的有关规定还有缺陷，应当废除《刑法》第306条、对律师执业豁免的例外情形做严格解释、修改《刑诉法》第38条。
