[Abstract]In accordance With the rapidly development of Internet-game industry, driven by interests, the cases of virtual property theft is often appeared in the newspapers. However, due to the lack of legal provisions, we encountered problems in the fields of theoretical and practical in the use of the law for the question whether the elements of virtual property theft can constitute larceny. In this paper, I try to explore the proposition from the characters of virtual property, combining with the target of larceny, especially from the ones for commerce and monopoly ,and to raise some legislative proposals in accordance with the current conservation staus.
