【摘要】随着不动产交易的日益频繁，有关土地、房屋等不动产错误登记所引发的损害赔偿责任问题也随之增加。虽然《物权法》第21条规定了不动产登记错误的赔偿责任，但对于登记机关的登记行为性质、审查义务、赔偿责任性质、归责原则以及登记错误损害赔偿救济制度的构建等，立法上并未明确，学界也存在较大争议，导致司法机关在实务中难以处理。本文从我国不动产赔偿责任制度现存的问题出发，结合学界各种观点的分析，并对国外相关制度进行研究借鉴，提出在明确不动产登记机关的审查义务、登记行为兼具行政行为和民事行为双重性质以及其赔偿责任性质兼具国家赔偿和民事赔偿双重属性的基础上，确立不动产登记赔偿责任的归责原则为过错推定责任原则，力图寻找一条符合我国国情的不动产登记错误赔偿救济之路。
