A FAMILY Court judge has denied a father any role in the parenting of his Exclusive Brethren children, in part because of his ``continuing criticism'' of the controversial Christian sect. In the judgment, judge Sally Brown ruled that, while there was a legal presumption that both parents should share parenting , this was ``contrary to the children's best interests'' in this case.
The father, who cannot be identified because of restrictions on reporting of Family Court cases, is ``devastated'', particularly as a previous court judgment had awarded him frequent access to two of his eight children. Justice Brown's judgment means he has no right to see or even communicate with the children, in a reversal of those previous court orders.

He also accepted that this was ``cruel, unacceptable and abusive behaviour towards these children'' by those Brethren members, and ordered the children have frequent and regular contact with their father. When this was not provided by the mother, Justice Benjamin found her guilty of contravening court orders and sentenced her to a suspended jail term.
The Full Court upheld the finding of contravention but overturned the sentence. The mother was diagnosed with breast cancer and extensive secondary cancers in May 2007 and no sanction was imposed.
In the latest case, the father argued that in light of the inability of his ex-wife to comply with the court orders, the only way he could see his children was for them to live with him. He later refined this to a request for orders that C, the 10-year-old girl, who had been the most receptive to him and his new wife during visits, live with him.
As well, he sought orders that J, the 15-year-ol
