After the Second World War respect to the independence of states has gradually been embodied in international law in the form of treaties as well as customary 1aw. The International Court of Justice, the successor of the PCIJ, confirms the principle that ‘independence’ is an integral character of statehood and the independence of any state is not to be compromised by any other state. In the Nicaragua v. the United States case(1986)the Court declared that‘in international law there are no rules, other than such rules as may be accepted by the state concerned, by treaty or otherwise, whereby the level of armaments of a sovereign state can be limited, and this principle is valid for all states without exception’.

二战以后对国家独立性的尊重逐渐在国际法的国际条约和国际习惯法中得以体现。作为国际常设法院的继任机构,国际法院确认了这项原则,承认独立是国家资格必不可少的特征,任何国家的独立性不得被侵犯。在尼加拉瓜VS美国案中,国际法院强调:在国际法中不存在能够限制一个主权国家的武装水平的规则,除非所涉国家通过条约或类似协议接受该规则。并且这一原则对任何国家都有效。
