In case BEG is legally required to bear taxes for the service fee under this Agreement according to the “Double Taxation Agreement between China and Germany” or according to “The Enterprise Income Tax Law of the People’s Republic of China”, FAW shall have the right to withhold from the payments to BEG such taxes for remittance to the Chinese Tax Authority on behalf of BEG is FAW presents to BEG official tax receipts therefore.
