信用卡诈骗罪，是指以非法占有为目的，利用信用卡，虚构事实、隐瞒真相，骗取公私财物数额较大的行为。利用信用卡犯罪，一般是指使用伪造的、作废的信用卡或者冒用他人的信用卡还有恶意透支的方法进行诈骗活动，它严重的破坏了我国的金融秩序，危害了公民的利益。本文就从信用卡诈骗罪的概念入手，分析了信用卡诈骗罪犯罪构成，并对其中的“使用伪造的信用卡”和“恶意透支”进行深入探讨。最后通过理论的研究，对完善我国刑法关于信用卡诈骗罪的立法提出了建议。
