“同性恋婚姻”的制度思考

摘要：本文关注的是“同性恋者之具有法律效力的结合”这一在近些年受到社会学家、法学家以及人类学家关心的热点问题，一方面从婚姻的本质属性入手，明确合法性和设权性并不是婚姻的本质属性。从婚姻的起源和仪式在婚姻缔结过程中的作用来看，婚姻是以夫妻名义公示共同生活的两者之间的结合，婚姻的本质属性为公示性。另一方面，又根据社会发展和人类进步的客观现实，分析婚姻内涵的变迁来阐述同性婚姻的理由，同时，就各国对这个问题的立法尝试，结合当今世界特别是我国这一特殊群体的现状，给出赋予这一特殊群体合法正当权益的建议和途径。
