最高人民法院院长肖扬说：“要切实通过司法活动将尊重和保障人权的原则全面贯彻到社会生活的各个方面。”如今公正和效率已经成为各级人民法院在二十一世纪的工作主题，而要确保司法公正和提高司法效率，就必须在司法活动中切实尊重和保障人权。二十一世纪，人权已受到空前的尊重和更好的实现，近年来，我国各级人民法院也将保障人权作为工作的重点，受到广大人民群众的拥护。然而，在司法实践中一些执法人员滥用职权，刑讯逼供，非法拘禁等现象，严重侵害了公民应有的权利，对此，笔者将就司法中存在的一些问题及在司法活动中如何保障人权发表一些粗浅的看法。
