本文通过对群众体育活动意外伤害法律责任的认定原则(过错责任原则、公平责任原则)以及对过错责任的免责条款的剖析，并利用文献法和实证案例分析法将群众体育活动意外伤害的赔偿及法律责任、救济等问题就一些典型案例结合我国现有的与群众体育意外伤害相关的法律法规进行分析研究，提出了完善群众体育意外伤害法律处理原则的几点建议。目的在于通过以法律的方式维护群众体育活动参与者的人身权利，在维护群众体育活动安全的同时促进群众体育事业的发展。我国在群众体育活动意外伤害方面一直缺少针对性的法律，对于群众体育活动中发生的意外伤害的侵权问题，其责任的认定我国没有统一的法律规定的标准，而且常有人认为发生在群众体育中的意外伤害不过是一般的民事侵权而已没有在法律上加以重视，忽略了其对群众体育事业及社会和谐稳定发展的重要性，积于群众体育活动本身的重要性和特殊性，制定相关的法律标准是必要的。群众体育活动意外伤害责任分为民事责任和刑事责任两种，通过研究发现这种伤害一般是通过民事诉讼解决的比较常见，直接导致刑事诉讼的很少，而且群众体育活动的保险是其法律的重要补充。
